YANG BERMASALAH SISTEM BANKNYA, MENGAPA QANUN
LEMBAGA KEUANGAN SYARIAH NO. 11 TAHUN 2018 YANG HARUS DI REVISI?
Permasalahan sistem yang dialami oleh Bank
Syariah Indonesia (BSI) selama 5 hari lamanya yang dimulai sejak 8 mei 2023 membuat
nasabah mengajukan keluhan, pasalnya nasabah tidak dapat mengakses akun bank
hingga tidak dapat melakukan kegiatan transaksi atau penarikan uang dari atm, ini
merupakan hal yang sangat fatal karena mengakibatkan terhambatnya roda
perekonomian hingga terhambatnya pemenuhan kebutuhan masyarakat. Bank Syariah
Indonesia (BSI) sendiri merupakan salah satu bank yang memiliki nasabah yang
cukup besar di Aceh, sehingga isu permasalah sistem yang dialami Bank Syariah Indonesia
(BSI) menjadi isu penting hingga menarik atensi petinggi daerah.
Ketua Dewan Perwakilan Rakyat Aceh (DPRA) Saiful Bahri (Pon Yaya) memaparkan bahwa
permasalahan pelayanan bank syariah di Aceh juga didasari oleh adanya Qanun
Lembaga Keuangan Syariah. Saiful bahri
menyamapikan “Kami sudah bermusyawarah di lembaga, kami menilai qanun LKS harus
ditinjau ulang supaya bank konvensional itupun bisa tetap beroperasi di Aceh.
Biar masyarakat merdeka memilih, mau dia ke neraka atau ke surga, biar dia yang
memilih itukan hak dia jangan pemerintah seolah-olah ini adalah surga ini
adalah neraka,”.
Saiful Bahri memeparkan adanya Qanun Lembaga Keuangan Syariah
(LKS) mengahambat roda perekonomian untuk dapat terjalin secara global, hal ini
didasari dengan terbatasnya jumlah akses bank untuk dapat melakukan kegiatan
transaksi.
Dengan perjuangan keringat, darah dan air
mata, Aceh berhasil mendapatkan hak istimewa untuk dapat mengatur otonomi
daerah secara mandiri. Kesempatan ini tentu menjadi media yang baik untuk dapat
mengatur sistem pemerintahan dan kepentingan masyakat. Dalam hal ini Aceh
memilih untuk menjalankan otonomi daerah sesuai dengan prinsip Syariah. Hal ini
membuat Provinsi Aceh berbeda dengan provinsi-provinsi lainnya. Prinsip syariah
ini lah yang melahirkan banyak undang-undang untuk dijalankan dengan prinsip
syariah, hingga muncullah Qanun Lembaga keuangan Syariah (LKS) no 11 tahun
2018.
Adanya permasalahan sistem yang
dialami oleh Bank Syariah Indonesia (BSI) tidak ada hubungannya dengan keharusan
untuk merevsisi Qanun Keuangan Syariah No. 11 Tahun 2018. Di Aceh sendiri tidak
hanya Bank Syariah Indonesia (BSI) saja yang menjadi satu-satunya bank yang
menganut sistem syariah. Tetapi juga terdapat bank-bank syariah lainnya,
seperti Bank Muamalat, Bank BCA Syariah, Bank Maybank Syariah, Bank Danamon
Syariah, Bank Bukopin Syariah, Bank BTN Syariah, Bank CIMB Niaga Syariah, Bank
BTPN Syariah hingga Bank Mega Syariah.
Merevisi
Qanun Lemabaga Keuangan Syariah No. 11 Tahun 2018 bukanlah cara yang efektif
untuk menyelasaikan permasalah ini, melainkan sistem dari Bank Syariah
Indonesia (BSI) lah yang harus di perbaiki. Pemerintah provinsi Aceh diharapkan
juga dapat mengajak bank syariah lainnya untuk membuka cabang lebih banyak di
daerah kabupaten di Aceh, untuk mencegah masyarakat untuk bekergantungan hanya
dengan 1 bank saja.
Merevisi Qanun Lembaga Keuangan Syariah No.
11 Tahun 2018 dengan memperbolehkan masuknya kembali bank konvensinal adalah
bentuk mempermalukan diri karena tidak mampu bertahan dengan apa yang sudah
ditetapkan. Seharusnya pemasalahan ini menjadi pembelajaran agar bank syariah
kedepannya dapat melakukan perkembangan dengan lebih baik lagi.
